Terms of Service

1. Scope

The following General Terms and Conditions (GTC) apply to the use of the dearlist app (hereinafter "App") and the associated website (hereinafter "Website") of konax media Günther Fick GbR (hereinafter "Provider" or "we").

By registering and using the App or Website, you fully accept these Terms of Service. If you object to these terms, you may not use the App and Website.

3. Service Description

dearlist is a mobile application for creating, managing, and sharing wish lists. The app allows users to:

• Create and manage wish lists
• Add wishes to a list
• Share lists with other users via a share code
• Reserve wishes to avoid duplicate purchases
• Access lists on multiple devices

Use of the basic features of the App is free. The Provider reserves the right to limit certain features or offer paid premium features.

4. Registration and User Account

4.1 Requirements

Registration is required to use the App. You must be at least 16 years old or have the consent of your legal guardian to use the App.

4.2 Registration Process

During registration, you must provide a valid email address and choose a secure password. You are obligated to provide truthful information.

4.3 User Obligations

You are responsible for:

• the confidentiality of your access credentials
• all activities that occur under your user account
• lawful use of the App

You must inform us immediately if you suspect that your account is being misused.

4.4 Account Limitations

Each user account can create a maximum of 5 own wish lists. The Provider reserves the right to adjust this number.

5. Rules of Use

5.1 Permitted Use

You may only use the App for lawful purposes and in accordance with these Terms of Service.

5.2 Prohibited Use

It is prohibited to:

• Use the App for illegal purposes
• Distribute malware, viruses, or other harmful programs
• Compromise or circumvent the security of the App
• Create or share false, offensive, discriminatory, or illegal content
• Violate third-party rights (in particular copyrights, trademark rights)
• Use automated systems or bots to access the App
• Copy, modify, decompile, or reverse engineer the App
• Use the App commercially without prior written permission

5.3 User Content

You retain all rights to the content you create in the App. By using the App, you grant us a non-exclusive, worldwide, free license to store, process, and display your content to the extent necessary for providing the App services.

You are solely responsible for all content you create, upload, or share in the App. You ensure that you have all necessary rights to use and share this content.

6. Availability and Maintenance

The Provider strives to ensure high availability of the App. However, we do not guarantee uninterrupted availability. Planned maintenance work will be announced in advance if possible.

The Provider reserves the right to modify, expand, or discontinue the App at any time.

7. Affiliate Links and Monetization

The App may contain links to products (e.g., Amazon links) through which we receive a commission on a purchase (affiliate links). These links are automatically tagged with our affiliate tag when you add product links to your wishes.

Using affiliate links does not incur any additional costs for you. The commission is paid by the product provider and does not affect the price you pay.

8. Liability

8.1 Limitation of Liability

The Provider is fully liable for intent and gross negligence as well as in accordance with legal provisions.

In case of slight negligence, the Provider is only liable for breach of an essential contractual obligation, the fulfillment of which is essential for the proper execution of the contract and on the compliance of which the user may regularly rely (cardinal obligation). In this case, liability is limited to the contractually typical, foreseeable damage.

8.2 Disclaimer

The Provider assumes no liability for:

• Loss or corruption of data, unless this is due to intent or gross negligence on the part of the Provider
• Damages resulting from improper use of the App
• Content created or shared by other users
• Products or services of third parties linked in the App
• Failures or disruptions outside the Provider's sphere of influence

8.3 Data Protection

Information on the processing of your personal data can be found in our Privacy Policy.

9. Termination

9.1 Termination by User

You can delete your user account at any time without giving reasons. Deletion can be done directly in the App.

9.2 Termination by Provider

The Provider may terminate and block your user account with immediate effect if you:

• violate these Terms of Service
• use the App for illegal purposes
• provided false information during registration
• have not used it for an extended period (at least 12 months)

9.3 Consequences of Termination

Upon termination, all your data will be deleted, unless there are legal retention obligations. Lists you have shared with other users will remain, but your wishes in these lists will be deleted.

10. Changes to Terms of Service

The Provider reserves the right to change these Terms of Service. Material changes will be communicated to you via email or through the App. If you do not agree to the changed version, you can delete your account. Continued use of the App after the change constitutes acceptance of the modified terms.

11. Final Provisions

11.1 Applicable Law

German law applies, excluding the UN Sales Convention.

11.2 Jurisdiction

The place of jurisdiction for all disputes arising from this contractual relationship is the Provider's registered office, if the user is a merchant, legal entity under public law, or special fund under public law.

11.3 Severability Clause

Should individual provisions of these Terms of Service be or become invalid, the validity of the remaining provisions shall remain unaffected.
